Terms and Conditions
Deans's Floral Coutue Ltd is the registered name for Magnolia the Florist, and therefore will be refered to as Magnolia the Florist in the continuation of rest the terms and conditions.
These Terms and Conditions apply to orders placed through the Magnolia The Florist website and form part of the agreement between you and Magnolia The Florist.
By placing an order through our website, you confirm that you have read and accepted these Terms and Conditions.
1. Products
1.1
All products displayed on this website are subject to availability and may vary from time to time. Products are available for delivery within our local delivery area and selected products are also available for national delivery, as described in Section 4.
1.2
Certain flowers and plants may be delivered in bud or partially in bud to help provide a longer vase or display life.
1.3
Some flowers, plants and other products may be harmful or poisonous if consumed or handled incorrectly. If you require further information about the suitability or safety of a product before placing an order, please contact us using the details in Section 6.
1.4
All products are subject to availability. Flowers are a natural product and the availability, colour, size and appearance of individual flowers may vary depending on seasonal availability and market conditions.
Where necessary, we reserve the right to substitute flowers, foliage, containers, accessories or other components with products of an equivalent or greater value and of a similar overall style and quality.
1.5
If we are unable to supply the product ordered or a suitable substitute, we will contact you where reasonably possible and arrange an alternative product or provide a refund for the affected product.
1.6
Product photographs are intended as a representation of the product. Due to the natural nature of flowers and plants, and differences in screens and photography, the finished product may vary slightly from the photograph shown on the website.
1.7 Alcoholic Products
Where an order contains alcohol:

The purchaser must be aged 18 or over.

Alcohol will only be supplied in accordance with applicable licensing legislation.

We operate an age-verification policy and may operate Challenge 25.

The person receiving an alcohol delivery may be required to provide acceptable photographic identification.

Alcohol may be refused if the recipient cannot provide satisfactory identification, appears to be under 18, or appears to be intoxicated.

Alcohol will not be left unattended or in a safe place for later collection.
It is a criminal offence for a person under 18 to purchase or attempt to purchase alcohol, or for an adult to purchase alcohol on behalf of someone under 18.
2. Prices
2.1
All prices displayed on our website are shown in pounds sterling (£) and, where applicable, include VAT.
2.2
Delivery charges are shown during the ordering process and may vary depending on the delivery service and destination.
2.3
We reserve the right to amend product prices at any time. The price payable for your order will be the price displayed when you place your order.
3. Orders and Payment
3.1
When placing an order, you must provide accurate and complete information, including your name, contact details, delivery address, postcode, recipient's name and any relevant delivery information.
3.2
You must also provide valid payment details and any other information reasonably required to process your order.
3.3
Submitting an order constitutes an offer to purchase the selected products. Your order is not accepted until we have confirmed acceptance of the order by email.
The automated email confirming that your order has been received does not necessarily constitute acceptance of the order.
3.4
We reserve the right to decline or cancel an order where, for example:

the product is unavailable;

we are unable to deliver to the address supplied;

payment cannot be authorised;
-
there is a pricing or website error;
-
we reasonably suspect fraudulent activity; or
-
the order would cause us to breach our legal or licensing obligations.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled order.
3.5
Orders may only be placed by persons aged 18 or over.
4. Delivery
4.1 Local Delivery
Our local delivery service operates within approximately a 10-mile radius of our shop at 20a Market Street, Kettering, Northamptonshire, NN16 0AH. All local delivery areas can be found on our delivery page.
Where we cannot make a delivery to an address in our local delivery area, we may contact you to discuss alternative arrangements or cancel and refund the order.
4.2 Local Delivery Times
Our normal local delivery times are:

Monday to Friday: 08:00–18:00

Saturday: 08:00–17:00

Sunday: No standard delivery
-
Public Holidays: No standard delivery unless specifically stated otherwise
During particularly busy periods, including Valentine's Day, Mother's Day, Christmas and other major floral occasions, delivery arrangements and delivery times may vary.
4.3
We will make reasonable efforts to deliver on the requested delivery date. However, delivery times cannot normally be guaranteed.
Funeral deliveries and other specifically agreed time-sensitive deliveries may be subject to separate arrangements.
4.4
We do not guarantee specific delivery times unless we have expressly agreed a specific delivery time with you.
Any delivery time or time preference entered into the Delivery Notes field should be regarded as a request rather than a guaranteed delivery time.
4.5
You must ensure that the delivery address and postcode supplied are accurate and complete.
We cannot accept responsibility for delays or failed deliveries resulting from incorrect, incomplete or inaccurate information supplied by the customer.
4.6
Where the recipient is not available, we may, where appropriate and safe to do so:
-
deliver to a neighbour;
-
leave the product in a suitable safe place;
-
leave a delivery card requesting the recipient to contact us; or
-
make further delivery arrangements.
Where a customer specifically instructs us to leave an item in a particular place, the customer accepts responsibility for that instruction once the item has been delivered there.
4.7
For deliveries to workplaces, offices, hotels, hospitals, care facilities, funeral directors and other organisations, delivery to an authorised person at the stated address may constitute delivery to the recipient.
Where a delivery is made to a reception area, mailroom, porter, reception desk or other designated receiving point, we cannot guarantee that the named recipient will personally receive the product.
4.8
We may contact the recipient using the contact details supplied with the order where this is reasonably necessary to complete the delivery.
4.9 Kettering General Hospital
We do not accept deliveries to departments located at Kettering General Hospital, NN16 8UZ.
If an order is placed for this location, we may contact the customer to arrange an alternative delivery address within our local delivery area.
If we cannot make alternative arrangements and cannot contact the customer, the order may be cancelled and refunded.
4.10 National Delivery – UK Mainland
Selected products on our website are available for national delivery by our delivery partner to UK mainland addresses.
National delivery products will be clearly identified on the website.
National Delivery Conditions

National delivery is available only on products specifically identified as being available for national delivery.

National delivery is currently available to UK mainland addresses only.

We do not currently offer national delivery to Northern Ireland, the Isle of Wight, Isle of Man, Scottish Islands, Channel Islands or other offshore islands or locations excluded by our delivery partner service.

Certain remote or restricted postcodes may also be excluded.

Delivery charges will be displayed during the ordering process.

National delivery dates and estimated delivery services are subject to the availability and operating arrangements of our delivery partner.

We will package flowers appropriately for transportation. Flowers may be supplied in a specially prepared, wrapped and hydrated presentation designed to protect them during transit.

Once your order has been collected by our delivery partner, the delivery is outside our direct control. Delays, traffic, weather, operational disruption or other circumstances may result in delivery taking longer than expected.

We will provide reasonable assistance in dealing with delivery issues and will work with our delivery partner to resolve problems where possible.

We cannot guarantee a specific delivery time for national deliveries.

Where our delivery partner is unable to complete delivery, they may leave the item according to its delivery procedures, attempt delivery again, leave the item with a neighbour, or direct the recipient to an appropriate collection point or depot.

Customers should follow any instructions provided our delivery partner regarding failed delivery or collection.

The customer is responsible for ensuring that the delivery address, postcode and recipient details are accurate and if possible a contact number for the recipient.

We cannot accept responsibility for delivery problems caused by incorrect or incomplete address information supplied by the customer.
4.11 National Delivery and Perishable Products
Flowers and plants are perishable products and are prepared specifically for the intended delivery date.
For this reason, national flower deliveries cannot normally be cancelled once the product has been prepared or dispatched, subject always to your statutory rights.
If a national delivery arrives damaged, significantly delayed or in an unsatisfactory condition, please contact us as soon as possible and, where appropriate, provide photographs of the product and packaging so that we can investigate the issue with the courier.
4.12
If we are unable to fulfil a national delivery order because the delivery address is outside our serviceable area, we will contact you where reasonably possible to arrange an alternative or provide a refund.
5. Cancellation and Amendments
5.1
If you wish to amend or cancel an order, please contact us as soon as possible using the details in Section 6.
5.2
For flowers and other perishable products, we may not be able to cancel or amend an order once the flowers or products have been purchased, prepared or dispatched.
5.3
Where an order is cancelled before we have incurred costs or begun preparation, we will normally provide a full refund.
Where preparation or other costs have already been incurred, any refund will be considered in accordance with applicable consumer law.
5.4
Nothing in these Terms and Conditions affects your statutory rights.
5.5
Where a product is faulty, damaged, not as described or otherwise does not meet your statutory rights, please contact us as soon as reasonably possible so that we can investigate and provide an appropriate remedy.

6.2
Because flowers and plants are perishable products, we recommend contacting us as soon as possible following delivery if there is a problem with your order.
Where appropriate, photographs of the flowers, product, packaging and delivery condition may assist us in investigating your complaint.
6.3
We will investigate complaints fairly and will seek to resolve them as quickly as reasonably possible.
7. Liability
7.1
Nothing in these Terms and Conditions limits or excludes any liability that cannot legally be limited or excluded.
7.2
We do not exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot legally be excluded or limited.
7.3
Subject to your statutory rights, we will not be responsible for losses which are not reasonably foreseeable or which arise from circumstances outside our reasonable control.
7.4
We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including severe weather, traffic disruption, courier disruption, strikes, supplier failures, power or telecommunications failures, natural disasters or other events outside our reasonable control.
7.5
Nothing in these Terms and Conditions affects your statutory rights under applicable consumer law.
8. Website and Product Information
8.1
We make reasonable efforts to ensure that the information displayed on our website is accurate and up to date.
However, errors, omissions or temporary technical problems may occasionally occur.
8.2
We reserve the right to correct errors, update product information and make reasonable changes to the website.
8.3
Colours and images displayed on computer, tablet and mobile screens may vary from the actual colour or appearance of flowers, plants and other products.
8.4
Flower availability varies throughout the year. We may therefore substitute individual flowers or foliage where necessary while maintaining the overall style, colour palette and value of the arrangement wherever reasonably possible.
9. General
9.1
We may update these Terms and Conditions from time to time. The latest version will be published on our website.
Changes will not affect orders that have already been accepted unless required by law or agreed with you.
9.2
We reserve the right to suspend or restrict access to our website where reasonably necessary, including for maintenance, security or technical reasons.
9.3
These Terms and Conditions should be read together with any other information, policies or notices displayed on our website, including our Privacy Policy and Delivery Information.
If there is any conflict between these Terms and Conditions and another website notice, the relevant consumer rights and applicable law will take precedence.
9.4 Data Protection
We process personal information in accordance with applicable data protection legislation, including the UK General Data Protection Regulation and the Data Protection Act 2018.
Please refer to our Privacy Policy for information about how we collect, use and protect personal information.
9.5
A person who is not a party to the contract between you and us shall not have rights under the Contracts (Rights of Third Parties) Act 1999 to enforce these Terms and Conditions, unless otherwise required by law.

These Terms and Conditions, together with the information provided during the ordering process and any policies expressly incorporated into them, form the agreement between you and Magnolia The Florist in relation to your order.
9.7
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.
9.8
These Terms and Conditions are governed by the laws of England and Wales.
Any dispute will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory consumer rights that may apply.
